CONDITIONS OF SALE

1. Scope

These General Terms and Conditions (hereinafter: GTC) apply to all orders and shipments between MySpirits S.r.l.s. (hereinafter: the Seller) and its customers through the website www.myspirits.it.

2. Ordering process, conclusion of the contract, quantity limits

Ordering process

The Seller offers its customers a wide range of products. Clicking on a product takes the customer to its product page, where the item details can be viewed. By selecting the desired quantity and clicking the cart symbol, the product is added to a virtual shopping cart.

By clicking "Cart" at the top right of the screen, the customer sees a summary of the selected goods and can check and change the selection.

To complete the purchase, the customer proceeds to checkout. Registered customers can log in to their account, where their saved details are used automatically for the current order. New customers can choose to register and create an account or continue without registering; in that case they enter the shipping address and the address for the order summary on the following screens.

During checkout the customer sees an order "Preview" with prices (VAT incl.), options and delivery costs.

To complete the order, and thus submit a binding offer, the customer must click "Buy".

Conclusion of the contract

The presentation of products in our e-shop is for information purposes only and does not constitute a binding offer of sale. Only when the customer clicks the "Buy" button do they send us a binding offer to conclude a purchase contract. The customer then receives an automatic email confirming receipt of the order. This confirmation does not yet constitute acceptance of the offer. The contract is concluded only when the Seller ships the goods to the customer and confirms the shipment by email.

Conclusion of the contract for advance bank transfer

If the customer pays in advance by bank transfer, the purchase contract is concluded when the Seller sends the payment details. The customer receives this communication within 24 hours of the order being processed. The order receipt confirmation is not the payment information. The amount must be paid no later than 7 days after the information email, by bank transfer to one of the accounts indicated. Payment is deemed made when the invoice amount is credited to our account; the date of the transfer is decisive for the payment deadline. If payment is not registered within these 7 days, the order is automatically cancelled.

3. Prices and delivery costs

All prices include Italian VAT.

The minimum order value for delivery is EUR 10.00 (excluding delivery costs). Selecting the courier and destination shows the updated shipping costs.

4. Shipping and delivery

Orders are fulfilled subject to stock availability. If not all products are available, the Seller reserves the right, where reasonable for the customer, to make a partial delivery at its own expense. If, due to supply problems not attributable to it, the Seller cannot ship the ordered product, it reserves the right to terminate the contract. In that case the Seller will inform the customer immediately and offer a product with similar characteristics. If no substitute is found or the customer refuses the proposed item, the Seller will immediately refund all amounts already paid.

Shipments within the European Union are free of customs charges. Any customs duties, taxes or additional fees for shipments to non-EU countries, in particular Switzerland, are borne by the customer.

If the goods are damaged in transit, the customer must inform Customer Service immediately, so that we can file a claim with the carrier or the insurance. Failure to notify does not affect the customer's statutory warranty rights.

5. Retention of title

The goods remain the property of the Seller until payment is received. Without the Seller's consent, the customer may not pledge, assign as security, transform or alter the goods before ownership is transferred.

6. Right of withdrawal (Italian Legislative Decree 206/2005)

Customers acting as consumers have a fourteen-day right of withdrawal. "Consumer" means any natural person acting for purposes outside their trade, business, craft or profession. The following provisions on the right of withdrawal and its exceptions apply. For any questions about the right of withdrawal, please contact Customer Service.

Withdrawal instructions

You have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier designated by you, take physical possession of the last item.

To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement sent by email to Customer Service.

To meet the withdrawal deadline, it is sufficient to send your communication before the withdrawal period has expired.

Return address: Via Mengaroni, 18 – 61025 Montelabbate PU – Italy

Effects of withdrawal

If you withdraw from the contract, we will reimburse all payments received from you, including delivery costs, without undue delay and in any event no later than 14 days from the day we are informed of your decision. We will use the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any case you will not incur any fees for the reimbursement. We may withhold the reimbursement until we have received the goods back or until you have supplied evidence of having sent them back, whichever is earlier.

The cost of returning the goods is borne by the customer.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Exceptions to the right of withdrawal

The right of withdrawal does not apply to the supply of: goods made to the consumer's specifications or clearly personalised; goods liable to deteriorate or expire rapidly; sealed goods unsuitable for return for health protection or hygiene reasons that have been unsealed after delivery; goods which, after delivery, are by their nature inseparably mixed with other items.

7. Warranty and liability

The statutory warranty provisions apply.

8. Payment methods and discount vouchers

Payment methods

Payments can be made by Credit card (including prepaid cards), PayPal, Amazon Pay, Satispay, Scalapay and advance Bank transfer. The Seller reserves the right to accept only certain payment methods. Postal orders and cheques are not accepted.

Advance bank transfer

The goods are shipped automatically once the payment is registered in our system, normally within 2-3 working days of the transaction. A copy of the transfer order cannot be accepted for processing the order.

Discount codes and vouchers

When redeeming a voucher, always check the conditions stated on it, such as the minimum order value or the expiry date. Only one discount can be used per purchase. Discount codes and vouchers are not transferable and cannot be exchanged for cash or refunded afterwards.

9. Final provisions

Should any provision of these General Terms and Conditions be invalid, the validity of the contract shall not be affected. Italian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
